ARTICLE 1 - DEFINITIONS
WEBSITE: The medium through which the SELLER sells its Products and Services to the Consumer over the internet and is represented as … in this agreement.
SELLER: The legal entity whose information is included in Article 6 of this Preliminary Information Form.
PRODUCT/PRODUCTS: Includes all goods and services sold to CONSUMERS on the WEBSITE.
CONSUMER: Refers to persons who order PRODUCTS via the WEBSITE.
CONTRACT: Contains the terms and obligations of the sales transaction made by the SELLER to the CONSUMER via the WEBSITE.
PRE-ORDER: These are pre-order sales transactions where the products offered for sale as Pre-Order by the SELLER begin shipping as of the estimated stock entry date specified on the product page.

The subject of the Preliminary Information Form is to inform the Consumer regarding the sale and delivery of goods and services sold through the website named https://www..............com ("Website") and whose characteristics and sales prices are determined below, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation No. 29188. In addition, this form aims to inform the Consumer that the shipment of the products they wish to purchase through pre-order will begin as of the estimated stock entry date specified on the product page.
ARTICLE 2 - GENERAL PROVISIONS
2.1. If the Consumer confirms the contract, the price and costs of the Product(s) ordered, as specified on this page, will be collected from the Consumer using the payment method they choose. The Consumer can pay for the products included in the order by choosing one of the following methods:
a) Payment by credit or debit card,
b) Payment via Digital Wallet (Garanti Pay, Pay with iyzico),
c) Payment by Gift Card.
2.2. The basic features of the Product/Products are included on the SELLER's website, in this Preliminary Information Form, in the Distance Sales Agreement and, if the product is subject to pre-order sales, in the Pre-Order Product Sales Agreement.

2.4. The Seller does not provide service outside of Turkey on the https://www..................com domain. Furthermore, if the contracted cargo companies do not have a branch close to the delivery address, the Consumer must collect the Product from another branch close to be specified by the Seller.
ARTICLE 3 - RIGHT OF WITHDRAWAL
3.1. The Consumer has the right to withdraw from the Agreement within 14 (fourteen) days from the date of receipt of the Product, without giving any reason and without paying any penalty. The Consumer may also exercise the right of withdrawal up to the time the goods are delivered.
3.2. The right of withdrawal period begins on the day the contract is formed for contracts relating to the performance of services; and on the day the consumer or a third party designated by the consumer receives the goods for contracts relating to the delivery of goods. However, the consumer may also exercise the right of withdrawal from the formation of the contract until the delivery of the goods. In determining the right of withdrawal period:
a) For goods that are subject to a single order and delivered separately, the day the consumer or a third party designated by the consumer receives the last good,
b) For goods consisting of more than one piece, the day the consumer or a third party designated by the consumer receives the last piece,
c) In contracts where the goods are delivered regularly for a certain period of time, the day on which the consumer or the third party determined by the consumer receives the first good is taken into account.
3.3. In order to exercise the right of withdrawal, the Consumer may (i) If the Consumer is a member of the Website, go to the My Orders page, select the product in the relevant order that they wish to return under the heading "Easy Return" and the reason for return, sign the e-invoice printout of the product/products with the Free Return shipping code provided by the Seller, and send it to the return address. (ii) If the Consumer is not a member of the Website, click the "Order Tracking" button at the top right of the Website homepage, enter the e-mail address they used when ordering and the order number they wish to cancel in the relevant boxes in the window that opens, click the "Inquiry" button, go to the returns page, select the product in the relevant order that they wish to return under the heading "Easy Return" and the reason for return, sign the e-invoice printout of the product/products with the Free Return shipping code provided by the Seller, and send it to the return address. (iii) You can contact customer services via the phone number in the Seller Contact Information section of this information form and follow the instructions provided to you, or (vi) You can make a clear notification of withdrawal via our e-mail address, contact address, telephone or fax number by filling out the sample withdrawal form in Annex-1.
3.4. The consumer must return the product within 10 (ten) days from the date of exercising the right of withdrawal, depending on the method chosen. The product, along with its invoice, the product box, packaging, any standard accessories, and any other products gifted with the product, must be returned complete and undamaged, all packaged together in a single package. The consumer is not responsible for any changes or deterioration that occur if the product is used as usual in accordance with its operation, technical specifications, and operating instructions during the withdrawal period. Accordingly, if any changes or deterioration occur due to failure to use the product in accordance with its operation, technical specifications, and operating instructions during the withdrawal period, the consumer may lose their right of withdrawal.
3.5. If the Consumer sends the Product to be returned via the cargo companies contracted by the SELLER (Yurtiçi Kargo, MNG Kargo, UPS Kargo, Packupp, Kargoist, Bovo Kargo), the fee paid to the transportation company for the delivery of the product to the Consumer will be reflected on the Consumer as the return cost.
3.6. Within 14 (fourteen) days from the Consumer exercising their right of withdrawal, all payments made by the Consumer for the relevant Product, including any Product delivery costs (provided the product is returned via the carrier specified by the SELLER for return), will be refunded to the Consumer in accordance with the payment method used at the time of purchase, without any cost or liability to the Consumer. In transactions made by credit card, the refund of the Product price to the bank will be processed by the SELLER, and will be reflected in the Consumer's account after the relevant bank's refund processing processes are completed.
3.7. If the amount falls below the campaign limit set by the SELLER due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign will be cancelled.
ARTICLE 4 – NOTIFICATION OF WITHDRAWAL
Withdrawal notifications can be sent to the Seller using one of the following options:
• If the Consumer is a member of the Website, he/she will go to the My Orders page and select the product he/she wishes to return and the reason for return under the "Easy Return" heading and send the notice of withdrawal to the Seller.
• If the Consumer is not a member of the Website, he/she will click on the "Order Tracking" button at the top right of the Website's homepage, then in the window that opens, write the e-mail address he/she used when placing the order and the order number he/she wishes to cancel in the relevant boxes, click on the "Query" button, then go to the return page and select the product he/she wishes to return and the reason for return under the "Easy Return" heading, and send the notice of withdrawal to the Seller.
• The Consumer may send the notice of withdrawal to the Seller by filling out the sample withdrawal form in Annex-1, via e-mail to our e-mail address …………………..com, by post to our address in …………………………………………………..Istanbul or by sending a fax to 0850 2525 572.
ARTICLE 5 - CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED
5.1. According to the legislation, the Consumer does not have the right of withdrawal in the following cases:
• In contracts regarding goods or services whose prices change depending on fluctuations in financial markets and are not under the control of the Seller (e.g. products in the jewelry, gold and silver category);
• In contracts regarding the delivery of goods that are prepared in line with the Buyer's wishes or clearly in line with his personal needs, are not suitable for return due to their nature and are in danger of rapid deterioration or have a possibility of expiration;
• In contracts regarding the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery and whose return is not suitable for health and hygiene reasons;
• In contracts concerning goods that are mixed with other products after delivery and cannot be separated due to their nature;
• In contracts regarding books, audio or video recordings, software programs and computer consumables offered in material form, provided that protective elements such as packaging, tape, seal, package are opened by the Buyer;
• In contracts regarding the delivery of periodicals such as newspapers and magazines, other than those provided within the scope of the subscription agreement;
• Contracts regarding accommodation, goods transportation, car rental, food and beverage supply and the evaluation of free time for entertainment or recreation purposes that must be made on a specific date or period;
• In contracts regarding the performance of services related to betting and lottery;
• Contracts regarding services that begin to be performed with the consumer's approval before the expiration of the right of withdrawal period; and
• Contracts regarding services performed instantly in electronic environment and intangible goods delivered instantly to the consumer (such as coupons).
• Goods or services excluded from the scope of the Distance Contracts Regulation
The right of withdrawal cannot be exercised in respect of (foodstuffs, beverages or other daily consumption items delivered to the Buyer's home through the Seller's regular deliveries and services in areas such as travel, accommodation, restaurant business and entertainment sector).
• In cases where the right of withdrawal is exercised for all or part of the ordered products (if any, exercised by the Consumer), and the purchase price falls below the minimum purchase amount in the SELLER's free shipping (delivery) campaign as a result of the right of withdrawal, the entire delivery and shipping fee not collected within the scope of the campaign will be deducted from the amount to be refunded to the Consumer. In cases where the Consumer has paid a delivery and shipping fee, this fee will be refunded in full to the Consumer.
• Any other products gifted with the product must be returned complete and undamaged in a single package. The consumer is not responsible for any changes or deterioration that occur if the product is used in accordance with its operation, specifications, and operating instructions during the withdrawal period. Accordingly, if the product is used in accordance with its operation, specifications, and operating instructions until the withdrawal date, the consumer may lose their right of withdrawal if the product is changed or deteriorated due to failure to use the product in accordance with its operation, specifications, and operating instructions.
5.2. The current rules and conditions applicable to the SELLER and the Consumer regarding transaction security, data protection, confidentiality, processing and use, and commercial electronic communications on the WEBSITE are presented to the Consumer as follows. The Consumer may contact the SELLER on these matters at any time using the specified communication channels.
5.3. SELLER is a member of the Istanbul Chamber of Commerce (ITO). The electronic contact information for obtaining ITO's professional code of conduct is as follows: (www.ito.org.tr, Telephone: 444 0 486).
5.4. After the information provided above/below is confirmed and accepted by the Consumer on the WEBSITE, all agreements will be sent to the e-mail address specified by the Consumer along with the order confirmation; they will be stored on the Consumer's device and accessible at any time, and will be kept in the SELLER's systems within the framework of relevant laws and for a maximum of three years.

ARTICLE 7 - PRODUCT SUBJECT TO ORDER/CONTRACT, PRICE, PAYMENT AND DELIVERY CONDITIONS
7.1. Delivery Information, including the Product Type and Kind, Quantity, Brand/Model, Unit Price(s), Sales Price, Payment (collection) Information, and the delivery location provided by the Consumer, are as follows. If the contracted cargo companies (Yurtiçi Kargo, MNG Kargo, UPS Kargo, Packupp, Kargoist, Bovo Kargo) do not have a branch close to the delivery address, the Product must be picked up from a designated branch close by. (The Consumer will be notified of this via email/email, SMS, or phone). Other delivery rules are set out below.

7.2. The ordered Product will be delivered to the Consumer or the third party/organization at the address provided by the Consumer, in accordance with the principles set forth below, provided that the legal 30-day period is not exceeded. For products sold through pre-order, the Consumer acknowledges that this period will begin as of the estimated stock availability date specified on the product page.
7.3. The SELLER sends and delivers the Products through a contracted cargo company. If this cargo company does not have a branch in the Consumer's location, the Consumer must pick up the Products from a nearby branch of the cargo company specified by the SELLER.
7.4. Except for products subject to pre-order sales, Products in stock are scheduled to be delivered to the cargo company within an average of five (5) business days from the date of order. The specified delivery times are notified to the Consumer at the shopping cart stage and are also specified in the informative email sent after the order is completed. If these estimated delivery times are extended, the Consumer will be notified separately by the SELLER.
7.5. In general, and unless expressly stated otherwise, delivery costs (shipping costs, etc.) are the responsibility of the Consumer. The order delivery fee of all our contracted cargo companies is a minimum of 19.90 TL, and the SELLER may not pass on all or part of these delivery costs to the Consumer, depending on the campaigns it runs at the time of sale and the terms of which are announced on the WEBSITE.
7.6. If the Consumer is not present at the address during the delivery of the Products and the persons at the address refuse to accept the delivery, the SELLER will be deemed to have fulfilled its obligation in this regard. If no one is present at the address to receive the Products, it is the Consumer's responsibility to contact the cargo company to track and ensure the shipment of the Products. If the Product is to be delivered to a person/organization other than the Consumer, the SELLER cannot be held responsible for the absence of such person/organization at the address or refusal to accept delivery. In such cases, all damages arising from the Consumer's late receipt of the Product, as well as any expenses incurred due to the Product being held by the cargo company and/or the return of the Product to the SELLER, are the responsibility of the Consumer.
7.7. The Consumer must pay the full purchase price, including all expenses, before receiving the Product. If the Product price is not paid in full to the SELLER before delivery for cash sales, or if the due installment amount is not paid for installment sales, the SELLER may unilaterally cancel the contract and not deliver the Product. If, for any reason, the Consumer does not pay for the goods or services, or if the payment is cancelled in bank records, the SELLER is deemed to be released from its obligation to deliver the goods or services.
7.8. If, for any reason after Product delivery, the bank/financial institution that issued the credit card used in the transaction fails to pay the Product price to the SELLER or requests a refund of the amount paid, the Product must be returned to the SELLER by the Consumer within seven business days at the latest. If the non-payment of the Product price is due to an unjust instruction or objection to the Bank by the Consumer, or to a defect or negligence, the shipping costs will be covered by the Consumer. The SELLER reserves all contractual and legal rights, including the right to pursue the Product price without accepting the return.
7.9. In cases where the Consumer pays the sales price using a credit card, installment card, etc., obtained from banks (including financial institutions), all facilities offered by these cards are credit and/or installment payment options provided directly by the card issuing institution. Product sales made within this framework, for which the SELLER collects the price in a lump sum or in stages, are not credit or installment sales for the parties to this Agreement, but are cash sales. The SELLER's legal rights in cases legally considered installment sales (including the right to terminate the contract in the event of non-payment of installments and/or to demand payment of the entire outstanding debt, including default interest) are available and reserved within the framework of the relevant legislation. In the event of default by the Consumer, default interest will be applied at a monthly rate as stipulated by applicable law.
7.10. For pre-order products, on-time delivery is defined as delivery to the Consumer within 30 days of the estimated stock availability date specified on the product page, or within 30 days of order confirmation for standard distance sales. If delivery cannot be made within the legal maximum 30-day period due to extraordinary circumstances outside of normal sales/delivery conditions (such as adverse weather conditions, heavy traffic, earthquakes, floods, fires), the SELLER will contact the Consumer using their current contact information to notify them of the delivery. In this case, the Consumer may cancel the order, order a similar product, or wait until the extraordinary situation is over.
7.11. If the SELLER determines that it cannot supply the Product subject to the Contract, it may supply another good/service of equal quality and price, provided that it clearly informs the Consumer via one of the same means and obtains their verbal/written consent within three (3) days of learning of this situation, and thus the SELLER shall be deemed to have fulfilled its commitment under the Contract. The Consumer is free to give or withhold such consent in all respects, and in cases where the SELLER does not give consent, the contractual and legal provisions regarding order cancellation (termination of the Contract) shall apply.
ARTICLE 8 - RULES ON SECURITY-PRIVACY, PERSONAL INFORMATION, ELECTRONIC COMMUNICATIONS AND INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
8.1. The privacy rules-policy and conditions specified below apply to the protection, confidentiality, processing-use and communications of information on the WEBSITE and other matters.
8.2. Necessary measures for the security of the information and transactions entered by the Consumer on the WEBSITE have been taken within the SELLER's own system infrastructure, within the limits of current technical capabilities, depending on the nature of the information and transaction. However, since the information in question is entered from the Consumer's device, the Consumer is responsible for taking the necessary precautions, including those against viruses and similar malicious applications, to protect it from unauthorized access.
8.3. In addition to and in confirmation of the permissions and approvals of the Consumer regarding personal data and commercial electronic communications provided by other means, the information obtained by the Consumer during their membership to the WEBSITE and purchases may be recorded, stored in printed/magnetic archives, updated, shared, transferred, used, and processed in other ways indefinitely or for a period determined by the SELLER, the company in which it is incorporated, and its future affiliates, subsidiaries, partners, successors, and/or third parties/organizations designated by them for the provision of various products/services and all kinds of information, communication, advertising-promotion, promotion, sales, marketing, store card, credit card, and membership applications for electronic and other commercial-social communications. These data may also be submitted to the relevant authorities and courts when required by law. The consumer consents and allows the use, sharing and processing of his/her current and new personal and non-personal information, in accordance with the legislation on the protection of personal data and electronic commerce legislation, and the sending of non-commercial electronic and other communications to him/her, within the above scope.
8.4. The consumer may stop data use and processing at any time by contacting the SELLER through the specified communication channels, or by exercising their right to refuse electronic communications sent to them. Based on the consumer's explicit notification in this regard, personal data processing and/or communications will be stopped within the legally maximum period. Furthermore, if the consumer so requests, their information, other than that which is legally required and/or possible to be preserved, will be deleted from the data recording system or anonymized in a manner that prevents identification. The consumer may, if they so desire, contact the SELLER and obtain information regarding the processing of their personal data, the persons to whom they are transferred, the correction of incomplete or inaccurate data, the notification of corrected information to relevant third parties, the deletion or destruction of data, objection to any adverse outcome resulting from analysis by automated systems, and compensation for damages incurred due to unlawful processing of data. Applications and requests regarding these matters will be fulfilled within the legally maximum period or may be rejected after the legal justification is explained to the consumer.
8.5. Regarding all information and content of the WEBSITE and their arrangement, revision and partial/full use, all intellectual and industrial property rights and property rights belong to the SELLER, except those belonging to other third parties in accordance with the agreement of the SELLER.
8.6. The SELLER reserves the right to make any changes it may deem necessary regarding the above-mentioned matters without prejudice to the Consumer's rights under the relevant legislation; these changes shall be valid from the moment they are announced by the SELLER on the WEBSITE or by other appropriate methods.
8.7. Other sites accessed from the WEBSITE have their own privacy-security policies and terms of use.
ARTICLE 9 - OTHER PROVISIONS
9.1. In case of order cancellations and terminations of the Contract, including withdrawals in accordance with the Contract and law, if the Product price has been collected, it will be refunded to the Consumer within a maximum of 14 days, in a manner appropriate to the payment method used. For example, in credit card payments, the refund will be made by refunding the Consumer's credit card, and the Product amount will be refunded to the relevant bank within the same period following the cancellation of the order by the Consumer. Since the reflection of this amount in the Consumer's account after the refund is made by the SELLER to the bank depends entirely on the bank transaction process, possible delays may occur due to reasons beyond its discretion. (Banks generally take up to three weeks to reflect the refund in the Consumer's account).
9.2. Consumers may submit their requests and complaints regarding the Product and sales to the SELLER verbally or in writing, using the communication channels specified above. SELLER is obligated to address the Consumer's legitimate requests, complaints, and all other applications. If such a resolution is not possible, the Consumer may, within the monetary limits set and announced annually by the Ministry of Trade, apply to the Provincial and District Consumer Arbitration Committees in their or the SELLER's place of residence (where they reside), or, for cases exceeding these limits, to the Consumer Courts.
9.3. With these Preliminary Informations, which will form an integral part of the Distance Sales Contract upon approval, the Consumer is informed about all matters including the basic features-qualifications of the Product/Products subject to sale, sales price, payment method, delivery procedures, right of withdrawal and personal information-electronic communication and reward points conditions.
9.4. All explanations and information in this Order-Contract Preliminary Information are valid as of the moment the Consumer approves it at the SELLER and, if accepted, they are bindingly applied together with the Distance Sales Contract between the SELLER and the Consumer.
ARTICLE 10 – WARNING ON PAYMENT OBLIGATION AND RIGHT OF WITHDRAWAL
10.1. If the Consumer approves this Preliminary Information Form and the Distance Sales Agreement, the price and costs of the Product(s) ordered will be collected from the Consumer using the payment method they have chosen. The basic features and total price of the Product:

10.2. The consumer may pay the product prices within the scope of the order by choosing one of the following methods:
a) Payment by credit card or debit card or
b) Payment via Digital Wallet (Garanti Pay, Pay with iyzico)
10.3. The Consumer has the right to withdraw from the Agreement within 14 (fourteen) days from the date of receipt of the Product, without giving any reason and without paying any penalty. The Consumer may also exercise the right of withdrawal up to the time the goods are delivered.
10.4. 10.5. (iii) You can contact customer services via the phone number in the Seller Contact Information section of this information form and follow the instructions provided to you, or (vi) You can make a clear notification of withdrawal via our e-mail address, contact address, telephone or fax number by filling out the sample withdrawal form in Annex-1.

• The Consumer may send the notice of withdrawal to the Seller by filling out the sample withdrawal form in Annex-1, via e-mail to our e-mail address ……………….com, by post to our address in ……………………………………………Istanbul or by sending a fax to +90 212 412 4400.
10.11. Cases in which the right of withdrawal cannot be exercised
According to the legislation, the Consumer does not have the right of withdrawal in the following cases:
• In contracts regarding goods or services whose prices change depending on fluctuations in financial markets and are not under the control of the Seller (e.g. products in the jewelry, gold and silver category);
• In contracts regarding the delivery of goods that are prepared in line with the Buyer's wishes or clearly in line with his personal needs, are not suitable for return due to their nature and are in danger of rapid deterioration or have a possibility of expiration;
• In contracts regarding the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery and whose return is not suitable for health and hygiene reasons;
• In contracts concerning goods that are mixed with other products after delivery and cannot be separated due to their nature;
• In contracts regarding books, audio or video recordings, software programs and computer consumables offered in material form, provided that protective elements such as packaging, tape, seal, package are opened by the buyer;
• In contracts regarding the delivery of periodicals such as newspapers and magazines, other than those provided within the scope of the subscription agreement;
• In contracts regarding accommodation, goods transportation, car rental, food and beverage supply and the evaluation of free time for entertainment or recreation purposes that must be made on a specific date or period;
• In contracts regarding the performance of services related to betting and lottery;
• Contracts regarding services that begin to be performed with the consumer's approval before the expiration of the right of withdrawal period; and
• Contracts regarding services performed instantly in electronic environment and intangible goods delivered instantly to the consumer (such as coupons).
• Goods or services excluded from the scope of the Distance Contracts Regulation
The right of withdrawal cannot be exercised in respect of (foodstuffs, beverages or other daily consumption items delivered to the Buyer's home through the Seller's regular deliveries and services in areas such as travel, accommodation, restaurant business and entertainment sector).
• In cases where the right of withdrawal is exercised for all or part of the ordered products (if any, exercised by the Consumer), and the purchase price falls below the minimum purchase amount in the SELLER's free shipping (delivery) campaign as a result of the right of withdrawal, the entire delivery and shipping fee not collected within the scope of the campaign will be deducted from the amount to be refunded to the Consumer. In cases where the Consumer has paid a delivery and shipping fee, this fee will be refunded in full to the Consumer.
• Any other products gifted with the product must be returned complete and undamaged in a single package. The consumer is not responsible for any changes or deterioration that occur if the product is used in accordance with its operation, specifications, and operating instructions during the withdrawal period. Accordingly, if the product is used in accordance with its operation, specifications, and operating instructions until the withdrawal date, the consumer may lose their right of withdrawal if the product is changed or deteriorated due to failure to use the product in accordance with its operation, specifications, and operating instructions.
